Minelab Electronics Pty Limited (Minelab), in conjunction with Chinese authorities, has successfully undertaken enforcement actions against two known counterfeiting manufacturers of Minelab products. Each of these organisations has now been prosecuted, resulting in significant fines and fixed-term prison sentences for the individuals involved.
Details are as follows:
Case 1
The Legal Representative of Company 1 [names have been withheld] was convicted of committing the crimes of:
As a result of these serious crimes, the Legal Representative of Company 1 has been sentenced to a fixed term of imprisonment of 4 years and imposed a fine of RMB 180,000. The seized counterfeit products have been confiscated from Company 1 and will be destroyed by the Public Security Bureau (PSB) authority in China.
Case 2
The Legal Representative of Company 2 has committed the crime of counterfeiting a registered trademark. As a result, the Legal Representative of Company 2 has been sentenced to an imprisonment of 3 years and 6 months, and imposed a fine of RMB 250,000.
In addition the manufacturing supervisor of Company 2 has committed the crime of counterfeiting a registered trademark, and is sentenced to an imprisonment of 1 year and 7 months, and imposed a fine of RMB 20,000.
The seized counterfeit products have been confiscated from Company 2 and will be destroyed by the PSB authority in China.
These results are an illustration of the serious consequences that attach to engaging in the manufacture of counterfeit products. Minelab has, and will continue, to pursue all infringers of its trademarks and the manufacturers and distributors of counterfeit products to ensure that it retains the integrity of its brand. In doing so, Minelab will seek to have appropriate criminal actions taken against any such organisations and Minelab will also seek civil damages from those that attempt to defraud our valued customers and the legitimate detecting industry.
